PlayMaker® -- Limited Warranty

BIOSPACE CORPORATION ("BIOSPACE") warrants each BIOSPACE PlayMaker® to be free from defects in material and workmanship when used properly in the specified manner for which it is intended. This Limited Warranty shall, in no event, extend beyond thirty (30) days from the date of purchase. BIOSPACE will replace any BIOSPACE PlayMaker® which is found to be defective during the warranty period, provided such is found to be defective due to defective material or as a result of defective workmanship and provided such PlayMaker® is returned to BIOSPACE CORPORATION at its offices located at 1720 Lincolnshire Blvd., Mississauga, Ontario, Canada L5E 2S7, prepaid and in its original or equivalent shipping container, within thirty (30) days of discovery of the defect. This Limited Warranty is not transferable or assignable in any manner. All BIOSPACE PlayMaker®s found to be defective due to defective material or as a result of defective workmanship, shall be replaced pursuant to the terms of this Limited Warranty free of charge to the customer, including shipping costs. BIOSPACE PlayMaker®s damaged due to breakage or shipping are not covered by this Limited Warranty.

BIOSPACE CORPORATION will replace a customer's defective PlayMaker® provided the BIOSPACE PlayMaker® was properly installed and used in the specified manner for which it is intended, and provided the customer, within thirty (30) days of discovery of such defect, has submitted a claim to a BIOSPACE representative or to BIOSPACE CORPORATION at its offices located at 1720 Lincolnshire Blvd., Mississauga, Ontario, Canada L5E 2S7, and provided the customer provides BIOSPACE with the defective PlayMaker® to determine the extent of defectiveness and provided BIOSPACE determines such defectiveness was caused directly and solely by a defect in material and workmanship in the BIOSPACE PlayMaker®.

THE ABOVE IS A LIMITED WARRANTY AND IT IS THE ONLY WARRANTY MADE BY BIOSPACE CORPORATION. BIOSPACE CORPORATION MAKES AND CUSTOMER RECEIVES NO WARRANTY, EXPRESS OR IMPLIED, OTHER THAN AS HEREINABOVE SET FORTH, AND THERE IS EXPRESSLY EXCLUDED ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OF USE. BIOSPACE CORPORATION SHALL HAVE NO LIABILITY TO CUSTOMER WITH RESPECT TO ITS OBLIGATIONS UNDER THIS LIMITED WARRANTY FOR CONSEQUENTIAL, EXEMPLARY OR INCIDENTAL DAMAGES. THIS LIMITED WARRANTY IS IN LIEU OF ALL LIABILITIES OR OBLIGATIONS OF BIOSPACE CORPORATION FOR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE BIOSPACE PlayMaker®.

SOME PROVINCES OR STATES DO NOT ALLOW THE EXCLUSION OR IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM PROVINCE TO PROVINCE OR FROM STATE TO STATE.
